OSHA Porta Potty Rules for Mississippi Construction Crews

OSHA rule 29 CFR 1926.51 requires 1 toilet for a crew of 20 or fewer workers. Crews of 20 or more need 1 toilet seat and 1 urinal per 40 workers. Crews of 200 or more need 1 seat and 1 urinal per 50 workers. Mississippi follows federal OSHA for private employers, so these numbers apply on Gulf Coast jobsites.

OSHA's construction sanitation rule sets a minimum number of toilets by crew size. Here is how Table D-1 works, what it

What does OSHA Table D-1 require on a construction site?

OSHA Table D-1 in 29 CFR 1926.51(c) sets 3 tiers. Twenty or fewer workers need 1 toilet. Twenty or more need 1 toilet seat and 1 urinal per 40 workers. Two hundred or more need 1 seat and 1 urinal per 50 workers. One standard porta potty has both a seat and a urinal.

The full text is in OSHA 29 CFR 1926.51, Sanitation. Count the most workers on site on your busiest day, including subs. A slow week does not lower the number you need on pour day.

Workers on siteOSHA minimumStandard units
1 to 201 toilet1
21 to 401 seat + 1 urinal per 401
41 to 801 seat + 1 urinal per 402
81 to 1201 seat + 1 urinal per 403

Sites without a sewer hookup can use chemical toilets, which is what a porta potty is. Mobile crews with a truck and nearby restrooms are exempt from paragraph (c).

Does OSHA require handwashing at construction sites?

Yes. OSHA 1926.51(f)(3) says lavatories shall be made available in all places of employment, with soap and towels. Paragraph (f)(1) adds washing facilities near the work for painters, coaters and anyone handling harmful contaminants. A 2-sided hand-washing station gives 2 workers soap, water and paper towels at once.

A standard unit has hand sanitizer, not running water. That is fine for many crews, but painting, concrete, roofing tar and pesticide work call for a real wash. Put a hand-washing station next to the toilets so workers use both.

The rule has limits. Mobile crews and normally unattended sites with washing nearby are exempt from the lavatory rule. If your site is fixed and staffed, plan on a wash station.

What are the OSHA toilet rules for farm crews?

Farm fieldwork falls under OSHA 29 CFR 1928.110, not 1926.51. Farms with 11 or more hand laborers in the field on a given day must provide 1 toilet and 1 handwashing facility per 20 workers. Each must sit within a quarter-mile walk of the work, or at the closest vehicle access point.

The OSHA field sanitation standard, 1928.110 also exempts workers who spend 3 hours or less in the field that day, counting travel time. Toilets and sinks must stay clean and working, and handwashing water must be refilled as needed.

For harvest crews, set the toilet and wash station together at a firm spot on the field road. The service truck must park within about 30 ft of both units.

How many porta potties does a 12-person framing crew need?

A 12-person framing crew needs 1 porta potty under OSHA Table D-1, because 20 or fewer workers need 1 toilet. With weekly service, 1 standard unit handles 12 workers on a 40-hour week. In July and August heat, twice-weekly service keeps that single unit usable.

Legal minimum: 1 toilet.

Our recommendation: 1 standard unit with twice-weekly service from June through September. If drywall, electrical and HVAC subs overlap with framers and the count tops 20, add a second unit. Add a hand-washing station once painters arrive.

See construction porta potty rental for how weekly service works.

How many porta potties does a 45-person commercial job need?

A 45-person commercial job needs 2 toilet seats and 2 urinals under OSHA Table D-1. The math is 45 divided by 40, which equals 1.125, rounded up to 2. Two standard units meet the minimum because each unit holds 1 seat and 1 urinal.

Legal minimum: 2 standard units.

Our recommendation: 3 standard units plus 1 hand-washing station on a 45-person site. Two units serving 45 people fill fast, and lines at break time cost labor hours. On a large site, split units into 2 clusters so no one walks across the whole job.

For bigger crews or multi-phase projects, the porta potty calculator helps you plan. Units on a long project are billed in 28-day cycles under long-term porta potty rental.

How often should jobsite porta potties be serviced in summer?

OSHA 1926.51 does not set a cleaning schedule, but it does require sanitary toilets. Standard planning assumes weekly service. For crews of 10 or more in July and August, twice-weekly service is the better choice, because Gulf Coast highs in the low 90s °F speed up odor.

Each service visit pumps the tank, washes and disinfects the unit, and restocks paper and sanitizer. Extra visits cost $45 per unit. For a full price breakdown, see the porta potty rental cost guide.

Shade helps too. A unit parked on hot asphalt in full sun smells worse by Wednesday than one under a tree line. Read more in our guide to porta potty odor in summer heat.

Related questions

Does OSHA say exactly 1 porta potty for 20 workers?

Yes. Table D-1 says 20 or fewer workers need 1 toilet. Past 20 workers, the rule switches to 1 seat and 1 urinal per 40 workers, so 1 standard unit still covers up to 40.

Do I need a separate unit for women on my crew?

Table D-1 sets counts, not genders. Single-occupancy units lock from inside, so any worker can use any unit. Many contractors still add a unit for comfort on mixed crews.

My roofing crew moves to a new house every 2 days. Do they need a toilet?

Mobile crews with a vehicle and nearby toilets are exempt from paragraph (c). If the crew works at one site long enough that driving to a restroom is not practical, place a unit.

Is hand sanitizer enough to meet the handwashing rule?

Not always. OSHA 1926.51(f) asks for soap and running water at lavatories, and washing facilities near work with paints, coatings or other harmful contaminants. A hand-washing station covers that.

Does weekly service count toward OSHA rules?

OSHA requires sanitary facilities but sets no service schedule. Weekly service is included with every 28-day rental, and twice-weekly service is available for big or summer crews.
